Warranty Terms
1 SCOPE
1.1
These warranty terms apply to the sale of products with a warranty (the "Product" or "Products") by Warmatek (JT eCommerce Oy) (the "Seller") to its customers (the "Buyer"). Deviations from these warranty terms must be agreed upon in writing.
2 WARRANTY
2.1
The Seller provides a minimum warranty of twelve (12) months for the Products from the time of delivery. The Seller's warranty also includes the assurance that the Products comply with the Seller’s applicable product specifications under normal trade conditions, unless otherwise agreed in writing between the Buyer and the Seller ("Product Specifications"). Repair or replacement of a defective product does not extend the original warranty period of the product.
2.2
Defects include, among others, manufacturing and design faults and other deficiencies that impair the usability of the Product and occur during the warranty period. However, the Seller is not responsible for defects if it can show probable reasons that the deviation from the Product's normal quality or usability is due to circumstances attributable to the Buyer. Such circumstances may include accidents, usage contrary to the installation, usage, or maintenance instructions provided to the Buyer, or other improper handling of the Product.
2.3
In the event of a warranty breach, the Buyer's sole remedy and the Seller’s only obligations are: (i) reimbursement of the price upon return of the defective Product, or (ii) repair or replacement of the defective Product with a new one.
2.4
The Seller reserves the right to carry out warranty service on the Product. A condition for warranty service is that the Product is delivered to a service center designated by the Seller. If this requirement is not fulfilled and warranty service cannot be performed, the Buyer is responsible for any additional costs incurred as a result.
2.5
The Buyer must inspect the Products immediately upon receipt and submit a written complaint to the Seller if the Products deviate from the Product Specifications or are defective in relation to those specifications. Such claims must be submitted within fourteen (14) days from the date the defects were observed or should have been observed. The claim must include a complete list of the Products considered defective, along with detailed photographs of the defects. For each Product, the model and serial number should be specified, if possible. Before the Seller, at its discretion, approves any warranty claim, it has the right to inspect the defective Products and the actual usage conditions under which the defects were noted. Hidden defects must be reported in writing within fourteen (14) days of discovery or when they should have been discovered. The Buyer bears the burden of proof that the defect is hidden.
2.6
The Seller is not responsible under the warranty for any additional fees or costs. A replaced defective Product shall be returned to the Seller’s possession and ownership. If Products must be returned to the Seller, the Seller reserves the right to approve the transport costs in advance.
2.7
If the Products are suspected to be defective or not in accordance with the Product Specifications—even if no fault has yet been confirmed—their use is strictly prohibited.
2.8
The Seller is not responsible for a Product or part thereof that:
a) was damaged during transport that violates the Seller's delivery terms,
b) was damaged due to an accident after delivery or due to negligence or improper storage,
c) was used in violation of the instructions for installation, use, or maintenance or in any way that is unsuitable for its purpose, or if usage continued despite poor performance, or
d) is subject to normal wear and tear.
If the Buyer neglects the above duties of care, the Buyer is considered to have waived all claims regarding the Products.
2.9
If a Product is found during warranty repair to be free of defects or if the defect is not covered by the warranty, the Seller has the right to charge a reasonable fee for the service visit, even if no actual repair is performed.
2.10
In addition to the warranty provided under these terms or any separate agreement, the Seller makes no other express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose. For clarity, this warranty does not cover indirect losses or damages suffered by the Buyer or any losses or damages caused to third parties.
